New Horizon Luxury Transport Services LLC

(Hereinafter referred to as “New Horizon”)

1. GENERAL PROVISIONS

New Horizon Luxury Transport Services LLC, incorporated under the laws of the United Arab Emirates (UAE) and licensed by the relevant transport authority, enables its users (“User” or “Customer”) to book luxury transportation services via its online platform, mobile applications, or other digital tools (“NH Tools”).

These General Terms and Conditions (“T&Cs”) form an integral part of every agreement between New Horizon and the User regarding the booking of transportation services. Conflicting terms provided by the User are expressly excluded unless New Horizon agrees in writing.

2. CONTRACTUAL RELATIONSHIP AND CONTRACT CONCLUSION

2.1 CONCLUSION OF CONTRACT

By submitting a completed booking request via NH Website/ Tools or through direct communication, the User submits an offer to conclude a service contract.
New Horizon shall confirm receipt of the request electronically or via telephone. The binding booking contract is only formed when New Horizon issues a Booking Confirmation.

3. REGISTRATION OBLIGATION OF THE USER FOR THE USE OF THE NH TOOLS

The User guarantees that all information provided during registration or booking is true, complete, and accurate. Automated or fraudulent registrations are prohibited.

4. SELECTED CONTENT OF THE TRANSPORTATION CONTRACT FOR THE BENEFIT OF THE USER

The User’s rights are limited to the terms outlined below:

4.1 Ride Types & Service Changes
• Rides may include transfers, long-distance rides, on-demand bookings, and hourly hires.
• Additional requests (e.g., stopovers, extensions, or upgrades) may incur extra charges.

4.2 Pickup Time
• The pickup time is as stated in the Booking Confirmation.
• For airport or metro station pickups, the pickup time will adjust in case of delays, provided the User supplied correct travel details.

4.3 Vehicle Class / Upgrade
• Users may choose from available vehicle classes. Specific vehicle models are not guaranteed.
• New Horizon may upgrade a booking at no additional charge, subject to availability.

4.4 Transport Safety & Conditions
• Luggage & Animals: Only pre-declared luggage, animals, or bulky items will be accepted. Additional charges may apply.
• Children & Minors: Child safety seats must be requested in advance. Transport of unaccompanied minors may be refused.
• Passenger & Luggage Limits: TSPs may refuse excess passengers or luggage for safety reasons.
• Impeded Transport: If transportation cannot proceed due to incomplete/incorrect User information, New Horizon retains its right to payment.

4.5 Delays
External factors (e.g., adverse weather, traffic restrictions, or flight disruptions) may lead to delays or cancellations, for which liability is limited.

4.6 Cancellations, Re-bookings and No-Shows
• Cancellation: Free cancellation is allowed if made more than one (1) hour before pickup. Otherwise, full charges apply.
• Re-bookings: Treated as new bookings. Cancellation terms apply to the original booking.
• No-Shows: If the User or guest fails to appear within 30 minutes (or 60 minutes for airport pickups) after the scheduled pickup, the booking will be deemed a no-show and fully chargeable.

4.7 Behavior in the Vehicle
• Seatbelts must be worn at all times. Passengers must comply with the chauffeur’s instructions.
• Smoking is prohibited. Alcohol may only be consumed with prior consent.
• Users are responsible for costs arising from vehicle damage or special cleaning caused by misconduct.

5. REMUNERATION AND PAYMENT

5.1 General Principles
The Booking Confirmation specifies the fare, which depends on the vehicle class, route, timing, and special requests.

5.2 Ride Changes
Any extensions (additional distance or hours) will be recalculated per the applicable tariff. Shortened rides will not reduce the fare.

5.3 Additional Charges
• Waiting Time: Free waiting is 60 minutes at airports/metro stations, 15 minutes elsewhere. Beyond this, charges apply per minute.
• Extra Kilometers: Hourly bookings include a set mileage. Additional distance will be charged separately.

5.4 Payment Modalities
Payment must be made by credit card or other approved methods. By adding a payment method, the User authorizes New Horizon and its payment partners to process payments.

5.5 Invoices & Due Date
Invoices are issued electronically. Payments are due immediately upon booking unless otherwise stated.

6. LIABILITY
• New Horizon’s Liability: Limited to damages caused by intent or gross negligence. For simple negligence, liability applies only to material obligations and foreseeable damages.
• No Liability: New Horizon is not liable for lost items, third-party website content, force majeure, or disruptions in digital services.

7. COMPLIANCE WITH UAE TRANSPORT REGULATIONS
• 7.1 Licensing & Regulation

All services provided under these T&Cs are subject to compliance with the rules and regulations of the UAE transport authorities, including but not limited to the Dubai Roads and Transport Authority (RTA), the Department of Transport (DoT) in Abu Dhabi, and other emirate-specific regulatory bodies.

• 7.2 User Acknowledgment

By accepting these Terms, the User acknowledges that all transportation is subject to regulatory oversight and that New Horizon and the TSPs must comply with UAE transport laws, including passenger safety requirements, vehicle standards, and professional conduct obligations.

• 7.3 Regulatory Overrides

If a regulation, directive, or ruling from the RTA or another UAE authority overrides or contradicts any provision of these T&Cs, the applicable regulation shall prevail without affecting the validity of the remaining provisions.

  1. AMENDMENT OF THE OFFER

New Horizon reserves the right to modify or discontinue NH Tools or services where reasonable or necessary, in compliance with UAE law.

9. PROTECTION OF CONTENT & RIGHTS OF USE
All content on NH Tools is protected under UAE copyright and intellectual property laws. Users are granted a limited, revocable, non-transferable right to use NH Tools solely for booking transportation.

10. FINAL PROVISIONS
10.1 Entire Agreement
These T&Cs constitute the entire agreement between New Horizon and the User. Amendments must be in writing.

10.2 Offsetting & Assignment
Users may not assign rights or offset claims without New Horizon’s written consent, unless legally established.

10.3 Governing Law & Jurisdiction
These T&Cs are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE, unless mandatory jurisdiction applies.

10.4 Severability
If any provision of these T&Cs is invalid or unenforceable, the remaining provisions remain in force.
